Warranty
Subject to the limitations set forth below, for a period of 5 years from the date of completion of the work described on the contract or proposal, Finest Finish Painting & Drywall (the “Contractor”) will repair paint and drywall deficiencies resulting from defective workmanship.
For this warranty to be valid, you must:
- Retain a signed copy of the original contract.
- Pay the entirety of the final invoice balance, including GST.
- Make the property accessible to the Contractor, or their employees, to perform the tasks required to complete the job as agreed upon in the contract.
This limited warranty does not cover the following:
Painting
- Any work where the Contractor did not supply the paint or other varnished surfaces made of, or containing, galvanized metals.
- Repairs to any surface that, by virtue of its design, permits moisture to collect. Surfaces include, but are not limited to, decks, railings, stairs, porches, roofs, and wood.
- Exact paint matches, as environmental conditions will affect the color and finish of all paints over time.
- Any repairs required as a result of a defect in the paint, regardless of whether the paint was supplied by the Contractor or not.
- Bleeding caused by knots or rust.
- Cracks in drywall or plaster not installed by Finest Finish.
- Peeling, blistering, or chipping where they are caused by:
- Peeling of layers of paint existing prior to the work performed by the Contractor.
- Structural settling or moisture content of the substrate.
- Abrasion, mechanical damage, abrasive cleaning, abuse, or damage resulting from the use of chemicals or cleaning agents or exposure to harmful solids, liquids, or gases.
- Damage or defects caused in whole or in part by reason of fire, explosion, flood, acts of God, extreme weather conditions, misuse, alterations, abuse, vandalism, negligence, or any other similar causes beyond the Contractor’s control.
Drywall

Splitting or Cracking Due to Pre-existing Structural Issues:
- This warranty does not cover drywall splitting or cracking resulting from structural issues such as inadequately-installed framing, excessive movement, warping, or settling. These conditions may cause the drywall to shift, leading to splits or cracks, which are beyond the Contractor’s control.

Pre-existing Drywall Deficiencies:
- This warranty excludes repairs to drywall or plaster surfaces not installed by Finest Finish Painting & Drywall. Deficiencies such as cracks, uneven surfaces, or poor-quality finishes from previous work are not covered under this warranty.

Mud and Taping Failures:
- The warranty does not cover splitting or cracking of drywall mud when skimming over existing Sheetrock that was improperly installed. This includes but is not limited to situations where the original drywall sheets were not properly screwed or glued, causing instability and subsequent cracking.

Worksite Climate Conditions:
- Damage due to extreme climate changes on the worksite, including rapid fluctuations in humidity and temperature, are excluded from this warranty. Specific factors include:
- Inadequate insulation in wall and ceiling cavities leading to condensation or temperature-related expansion and contraction.
- Single-pane windows allowing drafts that can cause temperature and humidity imbalances, leading to drywall movement and potential cracking.
- Power outages or electrical issues resulting in inactive heating systems, which can cause temperature drops affecting drywall stability.
- Damage due to extreme climate changes on the worksite, including rapid fluctuations in humidity and temperature, are excluded from this warranty. Specific factors include:

Heavy Construction and Ground Movement:
- Damage or defects resulting from heavy construction, drilling, blasting, or any similar activities occurring in the vicinity that cause ground movement are not covered under this warranty. Such activities can lead to shifts in the structure, resulting in drywall cracking or other damage.

Damage from Environmental or External Factors:
- This warranty does not cover damage caused by external factors such as fire, explosion, flood, acts of God, extreme weather conditions, or any other similar causes beyond the Contractor’s control. It also excludes damage resulting from misuse, alterations, abuse, vandalism, or negligence.

Surface Preparation and Adhesion Issues:
- The warranty does not cover issues arising from poor adhesion or surface preparation on areas where previous work was not adequately performed. This includes situations where existing layers of paint, wallpaper, or other materials have compromised the integrity of the drywall surface.

Settlement and Shrinkage:
- Cracks or defects resulting from natural settlement of the building or shrinkage of the framing members are not covered by this warranty. Such issues are often related to the natural aging and settling process of the structure and are beyond the Contractor’s control.
Additional Conditions:
- Subsequent Work:
- Any work performed on the drywall after the completion of the Contractor’s work that involves drilling, cutting, or modifying the drywall surface will void this warranty. This includes installations of new electrical wiring, plumbing, or other mechanical systems that penetrate the drywall.
Claim Process:
- To initiate a warranty claim, the client must contact Finest Finish Painting & Drywall with details of the issue. A site consultation fee of $150 will apply to assess the claim. If the claim is found to be valid under the terms of this warranty, the consultation fee will be credited toward the necessary repairs.
This limited warranty is the only expressed warranty made by the Contractor and is in lieu of all other warranties, expressed or implied. This warranty covers only those services provided by the Contractor to the original purchaser named on the front of the contract or proposal. In no event shall the Contractor be liable for incidental or consequential damages or damages in excess of the original contract price. This warranty may not be altered or extended for any purpose unless done so in writing in a document executed by all parties to the contract.
